Towers on Flamingo Habitat? CRZ Crackdown; Environmental Laws Lash Out at Luxury Housing Project

फ्लेमिंगो अभयारण्याच्या पर्यावरणीय संवेदनशीलतेला बाधा पोहोचवणाऱ्या पाम बीच मार्गावरील बहुचर्चित आलिशान गृहप्रकल्पावर अखेर पर्यावरणीय कायद्यांची कडक कारवाई झाली आहे. नेरूळ सेक्टर ६० येथील मिस्त्री कन्स्ट्रक्शनच्या या प्रकल्पाला सीआरझेड प्राधिकरणाने थेट मंजुरी नाकारत तो प्रलंबित ठेवल्याने पर्यावरणप्रेमी आणि कार्यकर्त्यांच्या संघर्षाला मोठे यश मिळाले आहे.

The Coastal Regulation Zone (CRZ) Authority has directed the project consultant, during its meeting, to submit detailed information regarding the exact location of the project, the current status of construction, and details of cases pending in court. Since construction activity was allegedly attempted in an environmentally sensitive zone, this action is being viewed as a formal warning. As a result, the construction permission granted by CIDCO to the project is also likely to come under serious scrutiny.

The authority has additionally asked for a site map clearly showing whether the project falls on the sea-facing side of the Palm Beach Road or on the landward side. As the luxury housing project is being developed on the sea-facing side of Palm Beach Road, its future now depends on the decision taken by the CRZ Authority and the stand adopted by environmental activists.

Project Land Falls Under CRZ-II Category

The project plot falls under the CRZ-II classification, under which construction permissions are required to strictly follow the directives issued by the Ministry of Environment, Forest and Climate Change dated 15 August 2018. As per these guidelines, the project was eligible for approval only with a Floor Space Index (FSI) of 1.0. However, CIDCO allegedly granted approval assuming an FSI of 1.5, which may now become a major point of contention.

On 25 August 2023, the Ministry revised the High Tide Line (HTL) buffer limit from 100 meters to 50 meters. Despite this, the developer Mistry Construction reportedly commenced construction activities. Since the CRZ law does not provide for post-facto (retrospective) approvals, the CRZ Authority, during its 193rd meeting held on 19 January 2026, directed the project consultant to submit updated details of the project’s current location and the status of related court cases, while keeping the final decision pending.

Municipal Corporation Had Raised Objections Earlier

In 2018, CIDCO granted Mistry Construction Company Ltd. permission for residential and commercial construction on a 27,000 sq. meter plot located in Pocket D and E of Nerul Sector 60. However, the Navi Mumbai Municipal Corporation, claiming itself as the city’s planning authority, officially raised objections to this approval. Environmental activists in the city also protested against the project, intensifying opposition and drawing attention to potential environmental violations.

With regulatory scrutiny increasing and public resistance growing stronger, the fate of this luxury housing project now hangs in the balance.
